Is Surrogacy legal in Georgia?

Since 1997 gestational surrogacy is legal in Georgia.

 What is Gestational Surrogacy?

Gestational Surrogacy is the legal and medical process through which a Surrogate woman carries the genetic material of the Intended Father or Sperm Donor and the Intended Mother or Egg Donor. 

Using the process of IVF (in-vitro fertilization) eggs are retrieved from the intended mother or egg donor's ovaries and fertilized with the sperm of the intended father or sperm donor to create Embryos.  Embryos are then transferred to the gestational surrogate mother's uterus where she will carry the fetus to term and deliver a baby for the Intended Parents.

What is the difference between Traditional Surrogacy and Gestational Surrogacy?

In Traditional Surrogacy, the Surrogate is genetically related to the child she is carrying - she is both the Egg Donor and the Surrogate. 

In Gestational Surrogacy, the Surrogate is not genetically related to the child.  She carries the genetic material of the Intended Parents (or Sperm/Egg Donors).  This type of surrogacy provides the opportunity to be genetically related to the child and is quickly becoming the choice for those who face infertility.  The legal protections for the Intended Parents in a Gestational Surrogacy arrangement are far more solid and offer more security.

What is the surrogacy process?

1. Request samples of the contracts: The intended parents, must request the sample of the contracts and get acquainted to the contract details first

2. Request information related to fees: Please choose the package (surrogacy, egg donation, surrogacy and egg donation, special care or refund packages) and ask for a total price.

3.  Sent us your e-mail address and request database access.  We provide you with password and login details for database access in order to view the potential candidate’s profiles.

4.  Plan your arrival and book ticket:  Plan your arrival date with your case manager .We will assist you from your arrival until your departure.

5.  The Matching Process: We will arrange meetings with several surrogacy candidates .

6.  Finalization of Agreement between Surrogate and Intended Parents: Meeting is scheduled between the Intended Parents and the Surrogate and her husband to discuss and agree on specific terms of the surrogacy contract.  We draft your agreement and it is signed by all parties and their counsel. 

7.  Payment:  Once all parties are cleared medically, the Surrogacy Agreement signed, the Intended Parents will be required to place start up funds in organization’s account

 

How long does it take to be matched with a Surrogate?

  It takes two days to interview several surrogacy candidates.

 

How is the Surrogate mother paid during the pregnancy?

Where will the Surrogate give birth?

Typically, the Surrogate will deliver your baby at a hospital local to her.  Usually, the hospital and obstetrician chosen are the ones that the Surrogate chose when her own children were born.  This, however, can be negotiated.

What happens if the Surrogate does not get pregnant or there is a miscarriage?

The number of times that the Surrogate will try for a pregnancy and birth is part of the negotiated terms.  If you have gone through the agreed upon amount of transfers with your Surrogate and she does not get pregnant and you wish to try again with a different Surrogate, you will be matched with a different woman.

 

Will my name be on the birth certificate?

Yes. You will be Legal mother on birth certificate.

 

 What is the legal process for obtaining a new birth certificate?

1. Within 1 day after the birth of a child delivered by a gestational surrogate, we will provide you with baby certificate. As soon as you receive baby certificate you will apply to your Embassy for baby passport which .It takes from two to six weeks to receive a baby passport and fly back with baby.
